Can you be separated while living in the same house?

Many separated couples continue living together, usually for financial reasons or for the children. Ontario law accommodates this, but it does require evidence that the marriage has genuinely ended rather than simply become strained.

• Whether you sleep in separate rooms
• Whether you have stopped sharing meals and social activities
• Whether finances have been separated or kept distinct
• Whether you present yourselves publicly as a couple
• Whether either party has communicated a clear intention to end the marriage
• Whether household tasks are still performed for one another

No single factor decides it. Courts look at the overall picture, and the date of separation can itself become a disputed issue — which matters, because it fixes the valuation date for property.

Practical advice

If you are separating under one roof, keep a simple written record of when the separation began and how arrangements changed. It is far easier to establish a date contemporaneously than to reconstruct it two years later.
