How long does a divorce actually take in Ontario?

The honest answer is that the divorce itself is usually the fastest part. What takes time is everything that has to be resolved around it.

Uncontested divorce

Where both spouses agree and all other issues are settled, a simple divorce commonly takes four to six months from filing. Most of that is court processing time rather than anything either party is doing. You must generally be separated for one year before the divorce is granted, though you can file and negotiate during that year.

Contested matters

Where parenting, support or property are in dispute, a year or more is common, and complex financial cases can run longer. The timeline is driven by disclosure, negotiation and court availability — not by the paperwork.

What actually causes delay

• Incomplete financial disclosure from one side
• Business or professional practice valuations
• Pension valuations
• Disagreement about the date of separation
• Assets held outside Canada
• High conflict that makes negotiation unproductive
